GENERAL TERMS AND CONDITIONS (GTC) ARTICLE 1 - DEFINITIONS In these conditions: Distance Contract: A contract concluded between The Challenge Zone B.V. and the customer within the framework of an organized system for the distance selling of products, digital content, and/or services. Customer: The natural person who is not acting for purposes relating to their commercial, industrial, craft, or professional activity. Withdrawal Period: The period during which the customer can exercise their right of withdrawal (14 days). The Challenge Zone B.V. (hereinafter: "We" or "Our"): Located at Herengracht 320, 1016 CA Amsterdam, The Netherlands, KVK number 98736590, which offers products and/or services remotely. ARTICLE 2 - APPLICATION OF THE GTC These general terms and conditions apply to every offer made by The Challenge Zone B.V. and to every distance sales contract concluded between The Challenge Zone B.V. and the customer. ARTICLE 3 - THE OFFER AND THE CONTRACT The contract is concluded at the moment the customer accepts the offer and fulfills the conditions set. The Challenge Zone B.V. is entitled to refuse an order or to subject its execution to special conditions if serious grounds justify not entering into the contract. ARTICLE 4 - RIGHT OF WITHDRAWAL (14-DAY PERIOD) The customer has the right to withdraw from a product purchase contract within a minimum period of 14 days without giving any reasons. We refer to our Refund and Return Policy for this. The withdrawal period commences on the day on which the customer, or a third party designated by them, acquires physical possession of the product. ARTICLE 5 - PRICE AND PAYMENT The stated prices include VAT. Payment must be made within 14 days of concluding the contract, or immediately upon delivery in the case of a physical product, unless otherwise agreed. ARTICLE 6 - INTELLECTUAL PROPERTY 👑 Our Intellectual Property (IP) specifically includes: The name and logos "THE CHALLENGE ZONE®", the "Gamified Fitness Method", the modular training system, the characters ("THE CHALLENGER"), the use of the lightning bolt symbol (7 lightning bolts children's range), the modular mats (for children and adults), the multiple game variants ( such as Base, Solo, Team Mode, Circuit, Hardcore Mode) as well as the unique victory conditions including the "Code 84" and the "Code 84 memory game find the pair" method. This covers all associated processes, visuals, and textual content. These elements are the copyright and/or trademark protected property of The Challenge Zone B.V. and may not be reproduced, distributed, or used without written permission. ARTICLE 7 - DELIVERY AND EXECUTION We refer to our Shipping Policy for estimated delivery times and shipping costs. The risk of damage and/or loss of products is borne by The Challenge Zone B.V. until the moment of delivery to the customer. ARTICLE 8 - DISPUTE RESOLUTION AND APPLICABLE LAW Dutch law exclusively applies to contracts concluded between The Challenge Zone B.V. and the customer.
